i ended up fixing it, it looked like i had double edges, but the normals were flipped on it.

here is my other problem, i want to create faces connecting the 2 edge loops that i have started to highlight

i have a feeling that the way im doing it seems to be the long way. Create one face at a time, duplicate, merg verts, repeat

does anyone have any idea of how to approach this

In future, please make these kinds of posts in the Modelling help forum.

I find this question a bit unclear also.

hope i got your question right:
in max you can select all the edges and shift-move or shift-upscale them (holding shift key makes new edges (with the faces) instead of changing just the selected edges). this will produce all the faces in one step.
something similar should be possible in maya.

In Maya there is a feature called append faces... Thats what your looking for. Just select append faces, then 1st edge, and then the second and it will build the face, and merge for you. But they have to both be open edges, cant be in the middle of a mesh. AKA face on one side but nothing on the other
